The "the" is there to help differentiate it from the 1989 Batman.
Those that have been following movie news, particularly superhero movie news, may know that Ben Affleck will co-write a new Batman script, with plans to direct. Ben Affleck has a good track record, so we think this makes sense. Affleck recently portrayed the Caped Crusader in the divisive Batman V Superman, where he was shown to be moodier than usual, which says a lot.
As far as Hollywood naming conventions go, The Batman isn’t the worst offender (see The Fast and the Furious for some egregious examples), but Affleck would like to stress that it is a working title at the moment. So it could change as the script comes together, with a new name that would reflect the thematic sensibilities.

So far, there’s not too much information about the new project. Affleck is working on the movie with Geoff Johns, Chief Creative Officer at DC Comics and total historian of all things DC. Joe Manganiello, best known for his ab-tastic performance in True Blood, will be Deathstroke, with Zack Snyder hinting the character may appear in his Justice League movie.
